('EAV', 'we', 'us', 'our') is a licensed real estate brokerage operating under AMI Licence AMI-7516, registered with IMPIC (Instituto dos Mercados Públicos, do Imobiliário e da Construção), with offices in Lagos, Lagoa, and Vilamoura, serving the Western Algarve and the Golden Triangle since 2006. Property photography and imagery is produced exclusively for EAV marketing purposes and may not be reproduced, republished, or repurposed without express written authorisation.

EAV's brand name, logo, AMI licence number, and award designations may not be used in any third-party communications without written permission.

5. Artificial Intelligence — Content & Services Disclosure

In line with our commitment to transparency and the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), EAV discloses the following uses of artificial intelligence:

5.1 AI-Assisted Content

Certain content on this website and in our marketing materials — including property descriptions, area guides, translations into our five site languages, video narrations, and social media content — may be generated or assisted by artificial intelligence tools and subsequently reviewed by our team.

While we take reasonable care to review AI-assisted content for accuracy, such content is provided for general informational purposes only. AI-generated translations and descriptions may contain errors, omissions, or imprecisions. The original property documentation, the Portuguese-language legal documents, and information verified directly with EAV staff shall always prevail over website content.

5.2 AI Virtual Assistant

Our website and WhatsApp channels may feature an AI-powered virtual assistant ('Sofia') to answer property enquiries. When you interact with the assistant, you are clearly informed that you are communicating with an AI system, not a human. The assistant does not provide legal, tax, immigration, or financial advice; such questions are referred to qualified human staff or external professional advisors. You may request transfer to a human agent at any time. Details of how conversation data is processed are set out in our Privacy Policy.

5.3 No Liability for AI Content

To the maximum extent permitted by law, EAV accepts no liability for any loss or damage arising from reliance on AI-generated or AI-assisted content, including errors in descriptions, translations, or automated responses. No property purchase decision should be made on the basis of website content alone; buyers must verify all material information through the formal due diligence process with independent legal representation.

6. Property Listings, Pricing & Information

All property listings, prices, dimensions, descriptions, floor areas, energy ratings, and availability are provided in good faith for general guidance only, are subject to change without notice, and do not constitute an offer or contractual representation.

Property prices are listed in Euros (EUR / €). Quoted prices exclude applicable Portuguese acquisition taxes and costs, including:

•     IMT — Imposto Municipal sobre as Transmissões Onerosas de Imóveis (Property Transfer Tax, progressive/variable rate);

•     IS — Imposto do Selo (Stamp Duty, currently 0.8% of the purchase price);

•     Notarial and land registry fees (typically 0.5%–1.0%);

•     Independent legal fees (typically 1.0%–1.5%);

•     Where applicable, real estate agency commission per the relevant brokerage agreement.

Buyers are strongly advised to engage an independent Portuguese lawyer (advogado) before committing to any transaction. EAV can provide referrals to qualified legal professionals on request.

7. Real Estate Brokerage — Legal Framework

EAV acts as a licensed real estate intermediary (mediador imobiliário) under Decree-Law n.º 211/2004, as amended, registered with IMPIC under AMI licence AMI-7516.

Completion of any property transaction is subject to execution of a Promissory Contract (CPCV — Contrato-Promessa de Compra e Venda) and final Deed of Sale (Escritura) before a Portuguese notary. EAV's brokerage role concludes upon execution of the deed.

EAV may represent buyers, sellers, or both parties (dual agency) as disclosed in the applicable brokerage agreement, acting at all times in accordance with its legal and ethical obligations under Portuguese real estate law.

8. Anti-Money Laundering (AML)

EAV is subject to Portuguese and EU Anti-Money Laundering legislation (Lei n.º 83/2017). For any property transaction at or above €15,000, we are legally required to verify the identity of buyer and seller (KYC), confirm the source of funds, retain identification and transaction records for a minimum of 7 years, and report suspicions to DCIAP. Failure to provide required documentation will prevent EAV from proceeding with or representing you in any transaction. This obligation is not discretionary.

9. Government Programmes & Investment Information

Information on this website regarding Portuguese government programmes — including residence visas, the Digital Nomad Visa, and Alojamento Local (AL) licensing — is provided for general orientation only and is subject to frequent legislative change.

!  Important note on the Golden Visa Programme: the real estate acquisition route was removed from the     Portuguese Golden Visa programme in October 2023 (Lei n.º 56/2023, 'Mais Habitação'). Property purchase     no longer qualifies for Golden Visa residency. Any references to the programme on this website relate to     the remaining non-real-estate investment routes or to historical context. Always verify the current legal     position with a qualified immigration lawyer before making any decision.

EAV does not provide immigration, tax, or investment advice. Prospective buyers must consult qualified legal and tax advisors regarding their individual circumstances.

•     Interruption, suspension, or unavailability of the website;

•     Errors, omissions, or inaccuracies in listings, pricing, translations, or availability data;

•     Any third-party website accessed via links on this website;

•     Any transaction entered into without independent legal advice.

Nothing in these terms excludes liability for death or personal injury caused by EAV's negligence, fraud, or any liability that cannot be excluded under Portuguese law or EU consumer protection legislation.

13. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Portugal. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Comarca de Faro, Portugal, without prejudice to applicable EU consumer protections and the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
